I will participate in the Camp Murdah (Event) by Scarity Haunted House at the venue of 425 Johnson Ln. in Billings, MT.
Should any Term or Provision of this Agreement be held invalid or unenforceable, the remaining Terms and Provision shall remain in full force and effect.
For the purpose of this Agreement the following with collectively be referred to as the “Releases”: Scarity Haunted House; 425 Johnson Ln., Billings, MT 59101; Asphalt Plus, Inc.; Melinda Oedekoven; their officers, directors, representatives, officials, principals, agents and/or employees; subsidiaries and/or assignees; as well as their independent contractors, sponsoring agencies, sponsors, advertisers and volunteers.
I understand that my volunteer duties not only involve acting, but also monitoring guests for safety violations and at times notifying the proper persons to escort the guests to the appropriate exit. As a volunteer, I understand that management must be notified of all incidents relating to guest problems, equipment failure and safety violations.
As a volunteer, I understand that my actions (both good and bad) are viewed by the public and directly affiliate me with Releases. As a volunteer, I understand that I shall not harass: guests; Releases; and/or co-volunteers. I understand that if my actions are deemed inappropriate, my volunteer duties will be cancelled and that I will be removed from the Event without warning.
I know and understand the importance of my attendance obligation after signing up and confirming a volunteer shift. I acknowledge that I am supposed to arrive each volunteer shift and agree to be on time. I agree to contact the volunteer coordinator as early as possible if some unforeseen event arises that prevents me from fulfilling a volunteer shift. I will follow all rules and expectations given to me during required training and communicated each night of attendance.
I irrevocably grant permission to Releases to photograph, film, videotape and record me, and my performance and subsequently to telecast, sell, distribute and otherwise utilize the same in whatever manner Releases deem appropriate. Such permission shall include granting the unlimited and irrevocable right to Releases without compensation of any kind to me, to use, reproduce or broadcast my name, nickname, image, likeness, voice, photographs or videos. I acknowledge the Releases shall have the unlimited right throughout the world to copyright, use, reuse, publish, republish, broadcast and otherwise distribute depiction of me and all or any portion of the Event in which I may appear on any and all radio, network, cable and local television programs and in any print materials and in any other format or media (including electronic media) now known or hereinafter devised in perpetuity and without compensation to me. In consideration and in return for being allowed to participate in the Event I release and agree not to sue the Releases from all present and future claims regarding my participation in the Event that may be made by me, my family, my heirs, next of kin, estate, personal representatives and or assigns.
I attest and verify that I am free from, but not limited to, all: illness; injuries; defects that could interfere with my safe participation. That I have no condition that will cause a severe reaction, but not limited to: strobe lights; loud noises; sudden movements; viewing haunters and haunted scenes. My participation in activities and events organized by Scarity Haunted House is entirely voluntary.
I acknowledge the existence of risks, possibly leading to injury. These risks include, but are not limited to: motion; heights; scare tactics; low lighting; loud music. Possible injuries include, but are not limited to: broken bones; sprains; lacerations; paralysis; death. I knowingly and freely assume and accept all such risks, both known and unknown, and assume full responsibility and all risks for my participation.
I hereby grant permission for a member of Scarity Haunted House to take whatever steps may be necessary to obtain emergency medical care for myself. I, for myself and on behalf of my family, my heirs, next of kin, estate, personal representatives and or assigns release and indemnify Releases from any and all liability or claims arising out of such treatment. These steps may include, but are not limited to the following:
- Attempt to contact a parent or guardian if the volunteer is a minor;
- Attempt to contact the volunteer’s emergency contact listed on file;
- A hospital or emergency service.
I, for myself and on behalf of my family, my heirs, next of kin, estate, personal representatives and or assigns forever, waive release, discharge and covenant not to sue Releases with any respect to any and all illness, accident, injury, disability, death and/or loss or damage to persons or property, incurred by me in connection with participation.
I, for myself and on behalf of my family, my heirs, next of kin, estate, personal representatives and or assigns further agree to indemnify, defend and hold harmless Releases from any loss, liability, cost, claim or damages arising from my participation in or association with activities and events organized and sponsored by Scarity Haunted House.
I, for myself and on behalf of my family, my heirs, next of kin, estate, personal representatives and or assigns fully acknowledge the risks of participating in this event and hereby forfeit my right to penalty, lawsuit and/or legal action against the Releases.
I have received, read and understand the foregoing Terms of this Agreement.
